Giorgio Remotti

Research topic: Blockchain, Smart Contracts, and IoT for the Agrifood Supply Chain: Fundamental Rights under the Test of Technological Innovation.

The research intends to study the impact that new technologies are having on the food production and distribution market, impacting on some fundamental rights such as, for example, consumer protection, health protection, freedom of economic initiative. In the last 10 years, Blockchain technology has developed, and with it also that of Smart Contracts and the Internet of Things. These systems allow new models of quality certification; thanks to 'augmented reality', commercial communication could be based less on signs and more on the information. If, on the one hand, the new blockchain technologies can contribute to improving the transparency and protection of the mark of origin for the benefit of the consumer and of Italian companies in the Agri-food sector; on the other hand, a partial regulation of the phenomenon that differs in the various EU Member States does not allow to fully grasp all the potential that this technology releases, and leaves operators freedom in the selection of the distinctive signs of their products which could cause information asymmetries to the detriment of consumers, as well as distortive effects on competition. This work intends to suggest exegetically possible solutions of connection between the abstract laws in force today and these new certification models that the market is developing to prevent interests such as consumer protection, health, and the free market not betrayed.
